Navigating Wildlife and Natural Resource in the Sooner State

Technical Transfer Seminar

EFO is pleased to present the first of our virtual Technical Transfer Seminars (TTS). The TTS will focus on “Navigating Wildlife and Natural Resource in the Sooner State” on February 17, 2021.  Technical Nossaman LLP’s Environment and Land Use partners, Rebecca Hays Barho and Brooke Marcus Wahlberg, will be addressing this topic. They will discuss how recent natural resource regulatory actions and related litigation may impact private corporations and public agencies operating in Oklahoma. The topics covered will include:

  • An overview and update on the litigation challenging the 2019 Endangered Species Act (ESA) amendments, including the “habitat” definition and Section 4(b)(2)
  • Developments related to the status of the monarch butterfly, American burying beetle, interior least tern, bat and other species in Oklahoma
  • An overview and update on the new Nationwide Permits (NWPs) and litigation involving NWP 12
  • An overview and update on the litigation challenging the National Environmental Policy Act (NEPA) regulatory amendments
  • An overview and update on the status of the Migratory Bird Treaty Act (MBTA) and related regulatory actions and litigation
  • A recap on other recent litigation affecting administration of ESA, NWPs and the National Historic Preservation Act (NHPA), including challenges to R Project and major pipelines
  • Recent and anticipated Biden Administration actions related to the above

Rebecca Hays Barho focuses her practice on natural resource law on a wide range of matters throughout the Southwestern U.S. She has assisted public agencies, local governments and private entities on issues related to the impending listing of species and potential implications on project delivery and implementation. Brooke Marcus Wahlberg’s natural resource practice focuses on powering the economy while maintaining compliance with environmental laws. She assists wind, solar, storage, pipeline and transmission line project developers with federal, state and local environmental and land use permitting strategies across the country.
